Terms of service

These terms are the agreement between you and Craig Simpson, trading as Berryhillock (“Berryhillock”), of [BUSINESS ADDRESS], for using Truck Drivers Diary: the app, the web panel at app.truckdriversdiary.com and this website. By creating an account you agree to them.

What Truck Drivers Diary is

Truck Drivers Diary is a personal record of your working day: your shifts, breaks, trips, mileage and fuel, with the totals worked out for you and exports you can pass on.

What it is not

  • It is not a tachograph and does not replace one. Your tachograph and its records remain the legal record of your driving, breaks and rest.
  • It is not legal, tax or compliance advice. The hours, break reminders, mileage and MPG figures are worked out from what you enter, to help you. Check them before you rely on them, for example before submitting a timesheet or a mileage claim.
  • You remain responsible for following drivers’ hours and working time rules and for keeping any records the law requires of you.

Your account

  • You must be 18 or over and use the app for your own records.
  • Keep your sign-in email secure. Anyone who can open your email can sign in as you.
  • Tell us at hello@truckdriversdiary.com if you think someone else has used your account.

Your data is yours

You own everything you put in your diary. You give us permission to store and process it only so that we can provide the service to you. You can download your records and delete your account at any time. Our privacy policy explains what we hold and how long we keep it.

Nobody else sees your diary unless you choose to share an export or send a timesheet.

The beta

Truck Drivers Diary is in beta. It is free to use during the beta. Features may change, and things may occasionally break. We will do our best to tell you before anything important changes.

Free and Pro

After the beta there will be two plans:

  • Free: logging shifts, breaks, trips and fuel, and your full history. This stays free.
  • Pro: adds PDF and CSV timesheet exports, the HMRC mileage log, receipt photos, the web panel and reminders. Pro will cost £2.99 a month or £24.99 a year. Drivers who took part in the pilot can keep Pro for £19.99 a year.

When Pro is available:

  • You can try Pro free for one month. Unless you cancel before the trial ends, the subscription starts and you are charged.
  • Pro is bought through the App Store or Google Play and is charged to your account with them. It renews automatically until you cancel.
  • You can cancel at any time in your App Store or Google Play subscription settings. You keep Pro until the end of the period you have paid for.
  • Refunds are handled by Apple or Google under their policies. Nothing in these terms affects your legal rights as a consumer.
  • If we change the price, we will tell you beforehand and the new price will apply from your next renewal.

If your Pro subscription ends, you keep your diary and everything in it. Only the Pro features stop.

Using the service fairly

Don’t misuse the service: don’t try to access other people’s accounts or data, interfere with how the service runs, or use it for anything unlawful.

Availability

We aim to keep the service running, and the app works without a connection, but we do not promise that the service will always be available or free of faults. Keep your tachograph records and any other records the law requires separately.

Our responsibility to you

We will provide the service with reasonable care and skill. We are not responsible for losses that were not foreseeable, that were not caused by us breaking these terms, or that are business losses. In particular, we are not responsible for fines, penalties or lost pay that result from relying on figures in the app without checking them.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.

Ending your account

You can stop using the service and delete your account at any time from the Account screen. We may suspend or close an account that seriously or repeatedly breaks these terms, and we will tell you why.

Changes to these terms

We may update these terms as the service changes. If a change matters, we will tell you in the app or by email before it takes effect. If you do not agree, you can delete your account.

Law

These terms are governed by Scots law. If you are a consumer, you can bring a claim in the courts of the part of the UK where you live.
